This Manager, Commercial Operations will be responsible to manage a Commercial & Claims Proposal Team, plan and organize the team’s resources, with the guidance and advice of a legal expert, and develop an integrated claim or offer strategy upon which to: (1) obtain, organize, and categorize supporting technical documents; (2) draft the Change Order or Claim; (3) provide the interface with and integration of Stone & Webster input to Consortium Change Orders and Claims; (4) obtain the necessary technical, legal, and commercial reviews; (5) prosecute the Change Order or Claim as appropriate; and (6) defend against claims made on Westinghouse and the Westinghouse/Stone & Webster Consortium when necessary.
You Day to Day:
Prepare Westinghouse Change Orders/Claims and defend Claims against Westinghouse with individual values as large as $100 M.
Organize and manage the Commercial and Claims Proposal Team of 7 to 10 technical experts and administrative support staff that will be drawn from the Commercial and Claims Department and NPP functional groups to include establishing and maintaining the necessary timelines and budgets for the team.
Implement the appropriate requirements of DC&P – WBAMS that apply to Change Orders and Claims.
Implement standards contained in Westinghouse “Code of Business Ethics & Conduct.” Ensure that all members of the team are informed about the standards and related policies and enforce them within this supervised activity.
Identify, analyze and prepare construction contract claims and disputes for Westinghouse’s nuclear power plant projects.
Provide assessment or validation of Westinghouse’s entitlement to change orders and quantification of damages.
Perform forensic investigations of contract documents, schedules, bid estimates, design documents, labor spent, and correspondence.
Investigate issues, gather relevant data, interpret data, and develop solutions to claims-related problems.
Prepare effective written and graphical illustrations of the facts in support of claims preparation and presentation.
Offer strategic insights for the analysis, quantification, preparation and presentation of claims.
Lead and motivate teams comprised of Westinghouse technical specialists in engineering, licensing, estimating and project controls to successfully complete tasks in gathering information pertaining to particular claim analysis and preparation.
Assist in the resolution of major financial, commercial and legal issues involved in commercial disputes between Westinghouse and its customer.
Assist in obtaining senior management approval for proposed change orders and claims in accordance with established Limits of Authority.
Assist in negotiations on behalf of Westinghouse with contract counterparties regarding commercial and contractual issues.
Develop and train less experienced Commercial & Claims Management personnel in the area of claims identification, analysis, preparation, presentation, and negotiation.
Keep abreast of emerging industry practices, trends, technologies, and dynamics in regard to construction contract claims and their strategic relevance to Westinghouse
Who You Are:
Bachelor Degree in business-related or engineering discipline required
JD would be a significant added advantage and preferred
Minimum of 15 years of experience in project commercial management
A track record of achievement and success in identifying, analyzing, preparing and presenting engineering, procurement, and construction contract changes and claims.
Highly effective writing ability and other communication skills for purposes of explanation and persuasion.
Well-developed negotiation and other problem-solving skills.
Experience in negotiations with customers, partners, and/or suppliers.
Effective at managing others.
Work in team environment and across organizations/companies
Ability to perform and complete work with minimal supervision.
